An eligible member who is entitled to covered retired pay may choose to get a one-time lump-sum now instead of part of their monthly pay until they reach retirement age. They can take a lump sum equal to the discounted present value of either 50% or 25% of the retired pay they would get from retirement until retirement age. If they take the 50% lump option, their monthly pay during that period will be 50% of the normal monthly retired pay. If they take the 25% lump option, their monthly pay during that period will be 75% of the normal monthly retired pay. Covered retired pay means retired pay under Title 10, Title 14, the NOAA Commissioned Officer Corps Act of 2002, or the Public Health Service Act. An eligible person is someone who first joined a uniformed service on or after January 1, 2018, or who made the election described in section 1409(b)(4)(B) or 12739(f)(2) of this title, and who does not retire or separate under chapter 61. Retirement age is the age defined in Social Security law (section 216(l)). The Secretary of Defense will estimate future retired pay with cost-of-living adjustments under section 1401a and then discount that total using average personal discount rates and standard actuarial methods to get the lump sum. The election must be made no later than 90 days before retirement. The lump sum must be paid within 60 days after retirement, or for reserve members within 60 days after the earlier of turning 60 or first becoming entitled to retired pay. Once the lump sum is paid, the amount cannot be challenged later because of changes in COLAs, actuarial assumptions, or similar factors. After the member reaches retirement age, their monthly retired pay will be recomputed effective the first month after that date to reflect the COLAs that would have applied under section 1401a. If no election is made, the person gets the normal retired pay. The Secretary of Defense must create rules to carry this out.
