State National Guard leaders get the chance to promote an Army or Air National Guard officer who a required or special federal promotion board picked. If the state appoints that officer into a vacant higher-grade slot before the federal promotion date, the officer will get federal recognition in that grade without the exam in 32 U.S.C. §307 and, subject to 10 U.S.C. §14311(e), will be promoted in the reserve grade effective on the appointment date. If an officer failed selection, the military department secretary may only grant federal recognition in that grade when that officer is the only qualified person to fill a vacancy, and the secretary cannot give that power to someone else. If, on the federal promotion date, the officer has not been appointed to a state vacancy at the higher grade, the officer’s federal recognition in the reserve grade is withdrawn and the officer is promoted and moved to the Army Reserve or Air Force Reserve as appropriate.
