§1448a Election to Discontinue Participation: One-year Opportunity After Second Anniversary of Commencement of Payment of Retired Pay

Summary

A participant in the Plan may stop participating during the one-year period that begins on the second anniversary of the date when payment of retired pay to the participant starts. A married participant must have the spouse’s written agreement, as the Secretary of Defense’s rules require, unless the participant proves one of the conditions listed in section 1448(a)(3)(C). The limit in section 1450(f)(2) applies when former spouse coverage is in effect. Rules about withdrawing the election and its consequences in section 1448(b)(1)(D) and (E) also apply. The Secretary must tell any former spouse or other person named under section 1448(b) about the election. The election takes effect on the first day of the first calendar month after the month the Secretary receives it. Paragraphs (4)(B) and (5)(C) of section 1448(a) do not stop this election.
