A participant in the Plan can choose to stop taking part during the one-year window that starts on the second anniversary of when their retired pay begins. If the participant is married, the spouse must agree in writing unless the participant can prove one of the conditions in section 1448(a)(3)(C) is met. The written spouse agreement must include the information the Secretary of Defense’s rules require. The limit in section 1450(f)(2) applies to this choice, and the rules in sections 1448(b)(1)(D) and 1448(b)(1)(E) also apply. The Secretary must tell any former spouse or other person previously named under section 1448(b) about the choice. The choice takes effect on the first day of the first calendar month after the Secretary gets it. Paragraphs (4)(B) and (5)(C) of section 1448(a) do not stop someone from making this choice.
