Reserve first lieutenants (Army, Air Force, Marine Corps) and reserve lieutenants (junior grade) (Navy) who fail promotion a second time and are not on the list recommended for promotion must be separated under section 14513. The separation must happen no later than the first day of the seventh month after the month when the Secretary releases the board’s second-time promotion results to the public. This rule does not apply if the Secretary keeps the officer for planned mobilization needs for up to 24 months from that release date, or as allowed by sections 12646 or 12686. An officer is treated as having failed selection if the Secretary decides the officer would be eligible for consideration by a board under section 14101(a) but the officer is not among the fully qualified officers the Secretary recommends under section 14308(b)(4).
