A military department Secretary can let a reserve commissioned officer ranked above O-2 stay on the reserve active‑status list past the normal separation or retirement date under sections 14505–14507 if the officer has a military specialty the Secretary names. If not retired, moved to the Retired Reserve, or discharged sooner, that officer will be separated under sections 14513 or 14514 on the first day after the month they reach 40 years of commissioned service. The Secretary of Defense will issue rules that tell department Secretaries how to choose qualifying specialties.
