Title 10 › Subtitle A — General Military Law › PART II — PERSONNEL › CHAPTER 76 — MISSING PERSONS › § 1505
The Secretary must keep looking into the whereabouts and status of anyone already found to be missing. Reviews must happen whenever new information arrives that could change the person’s status, and the Secretary must appoint a board to do the checks. If any U.S. intelligence office or other government unit finds possible information about a missing person, it must quickly send that information to the Secretary of Defense. The Secretary of Defense must add it to the person’s case file and tell the person’s lawyer, closest family member, and any other person the missing person had named. With the lawyer’s advice, the Secretary of Defense decides if the information is important enough for the board to review. If a board is appointed, it follows the same rules as the earlier review.
