The Secretary of Defense must create a process to do a final review when someone asks to change the characterization of a military discharge or dismissal. If a petitioner asks, the Secretary will look over the boards’ findings and decisions made under sections 1552 and 1553. After that review, the Secretary may recommend to the appropriate military department that the discharge or dismissal be upgraded. Definitions: “final review of a request for an upgrade in the characterization of a discharge or dismissal” — a request denied under sections 1552 and 1553 after the petitioner has used all available remedies under those sections. “Petitioner” — the member or former member, or if deceased, the surviving spouse, next of kin, or legal representative.
