The Secretary must set up review boards made of five commissioned officers. At least two members must be medical officers from the Army Medical Corps, Navy Medical Corps, Air Force medical officers, or the Public Health Service where appropriate. These boards will review, when asked, decisions that led to a member or former member to be retired or separated without pay for physical disability. A request must be made within 15 years of the retirement or separation. The review board has the same authority as the original board. Its findings go to the Secretary, who sends them to the President for approval. Reviews use military records and any other evidence offered. Witnesses may testify in person or by affidavit. The person asking for review may appear alone, or be represented by a lawyer or an accredited representative of an organization recognized by the Secretary of Veterans Affairs under chapter 59 of title 38.
