The Secretary of the Air Force must set up retention boards at times and places the Secretary chooses to hear evidence and decide whether an officer who is required under section 20501 to show cause should stay on active Space Force duty. Each board must have at least three officers who meet the qualifications in section 20506. The board must give each officer a fair, impartial hearing. If the board finds the officer did not prove they should stay, it must recommend one of three actions: move the officer to inactive status, retire the officer if law allows, or discharge the officer. Under Air Force rules, the officer may be put on leave after getting the board’s report and after any time allowed to submit a rebuttal; that leave can continue until the Secretary acts or be ended earlier. If the board finds the officer should stay, the case is closed. An officer kept under section 20501(a) cannot be required to show cause again for one year. An officer kept under section 20501(b) can be asked to show cause again at any time, except for the same conduct from the prior case unless the earlier findings were obtained by fraud or collusion. The board may also recommend extra training or education to fix problems.
