The Secretary of Defense can grant a security clearance to a facility of a covered company only if four rules are met. The company must appoint a senior officer, director, or employee who already has the same level of clearance the facility needs to act as the facility’s senior management official. Any company senior managers who do not have that clearance must not have access to classified information about the facility, and the company must certify to the Secretary that the appointed cleared person can act for the company on facility matters independently of un‑cleared managers. The facility must meet all other clearance requirements aside from the cleared senior management rule. A covered company is one that has a contract or agreement with the Department of Defense, helps the Department, or needs a facility to handle classified information.
