§239b — Title 10 Armed Forces | U.S. Code

Summary

When the Department of Defense sends its budget justification papers to Congress with the President’s budget under section 1105(a) of title 31 for fiscal year 2021 and every year after, the Secretary of Defense must not put money from the Military Intelligence Program and money from other sources into the same program element. Definitions: "budget" — meaning given in section 231(f) of this title. "defense budget materials" — meaning given in section 231(f) of this title.

(a)In the budget justification materials submitted to Congress in support of the Department of Defense budget for fiscal year 2021 and each fiscal year thereafter (as submitted with the budget of the President under section 1105(a) of title 31), the Secretary of Defense may not include in any single program element both funds made available under the Military Intelligence Program and funds made available outside of the Military Intelligence Program.
