The Secretary of Defense or a military department may make agreements with State, local, or other groups to care for and study cultural resources. Work under these agreements only happens if funds are available. Agreements can cover resources on a military installation, or off-base only if they directly reduce or remove current or expected restrictions that would interfere with military training, testing, or operations. Section 1535 and chapter 63 of title 31 do not apply. Cultural resources include places or objects on or eligible for the National Register (54 U.S.C. 302101); Native American cultural items (25 U.S.C. 3001(3)); archaeological resources (16 U.S.C. 470bb(1)); archaeological collections and records (36 C.F.R. 79); and Indian sacred sites (Executive Order 13007).
