Agencies listed in section 3063 must not be forced by law to give a new research, development, test, or evaluation grant to a named non‑federal organization. If a law points to a program, project, or technology, the award must be made by choosing the best proposals based on merit. A law only forces a grant to a named non‑federal organization if it (1) refers to this rule, (2) names the exact organization, and (3) says the award is required even though it breaks the rule. A "new grant" is one that is not just a continuation of prior work. Grants asking the National Academy of Sciences to study and report are not covered.
