The Secretary of Defense may run special personnel projects at certain Department of Defense labs called science and technology reinvention laboratories. These projects must be generally like the China Lake demonstration project (the special program used at the Naval Weapons Center, China Lake, and the Naval Ocean Systems Center, San Diego). The normal rules in 5 U.S.C. 4703 apply to these projects, with a few exceptions. One subsection of that law does not apply. The Under Secretary of Defense for Research and Engineering will carry out the Office of Personnel Management’s usual roles for these projects and must focus on making the labs run more efficiently. Lab employees under a project are not bound by statutory limits on supervisor-to-employee ratios or caps on numbers in job categories, and they will be managed by the lab director under the Under Secretary’s supervision. Limits in 5 U.S.C. 5373 do not restrict the Secretary’s power to set pay schedules and related benefits for these projects. Twenty specific labs are named as reinvention laboratories, including the Air Force Research Laboratory, the Naval Research Laboratory, the Office of Naval Research, the Joint Warfare Analysis Center, and several Combat Capabilities Development Command centers, among others. The Secretary must move civilian staff at those labs into the demonstration personnel system. That conversion must not reduce anyone’s pay or other job terms, must follow 5 U.S.C. 4703(f), must finish within 18 months after a lab is designated, and does not apply to prevailing rate employees or senior executives. These labs may not use any other personnel system without Congress’s permission.
