The Secretary of Energy cannot give bonuses, award fees, or other pay based on performance or production to contractors who run Department of Energy defense nuclear facilities unless, when judging performance or production, the Secretary counts whether the contractor followed all applicable environmental, safety, and health laws, rules, and practices in deciding both eligibility and the award amount. This rule covers contracts made or contract options used after November 29, 1989. The Secretary had to issue rules to put this into effect by March 1, 1990.
