Title 10 › Subtitle Subtitle C— Navy and Marine Corps › Part II— PERSONNEL › Chapter 841— VOLUNTARY RETIREMENT › § 8328
Do not count time a person had to make up under section 972(a) of this title if that makeup time happened after February 10, 1996. Also, any time the officer has listed under section 972(b) is left out when figuring years of service under this chapter. Months of active duty spent earning a baccalaureate degree in the Navy’s Seaman to Admiral (STA–21) program for candidates chosen on or after October 28, 2009 are not counted toward the years needed to be eligible for retirement after being made an ensign, unless the officer is involuntarily separated or retired for physical disability. Those months still count as active service for other purposes.
