The military can count certain absences or misconduct as lost time from a member’s service and pay. That happens when an enlisted member deserts; is absent without proper authority for more than one day; is held in custody for more than one day in connection with a trial; or cannot do duties for more than one day because of heavy drug or alcohol use or illness or injury caused by their own misconduct. The same rules apply to officers only for actions after February 10, 1996. The Secretary in charge must remove the lost-time penalty for any period of confinement tied to a trial if the charge is dismissed before or during trial, the member is acquitted, a conviction is later set aside (not by clemency), or a conviction is reversed on appeal and then dismissed or entered as a judgment of acquittal.
