The Secretary of Defense may carry out a sentence given by a military commission under this law, using procedures the Secretary creates. If the commission’s sentence includes death, that part cannot be carried out without the President’s approval. The President may reduce, cancel, or pause the death sentence. A death sentence also cannot be executed until all legal review is finished. A judgment is final after the U.S. Court of Military Commission Review finishes and either the time to ask the U.S. Court of Appeals for the D.C. Circuit has passed with no petition, or the Court of Appeals finishes and either no Supreme Court petition is filed, the Supreme Court denies it, or the Supreme Court completes review. The Secretary of Defense or the convening authority may suspend any sentence or part of it, except a death sentence.
