Require the Secretary of Defense to make DoD charter needs more predictable, strengthen participation in the Civil Reserve Air Fleet so enough capacity is available for normal operations and surges, and give incentives for carriers to use newer, more efficient planes. The Secretary must consider recommendations from the report required by section 356 of the National Defense Authorization Act for Fiscal Year 2008. The Secretary may award one-year charter contracts with a guaranteed minimum purchase amount to CRAF carriers. To get those guaranteed payments, a carrier must have had at least a 90 percent average on-time pick up rate last fiscal year (based on things the carrier controls), promise extra commitment to CRAF above the basic requirement, and not have refused to host other CRAF carriers at intermediate staging bases in the prior year. The total guaranteed amount for all contracts each year is set from forecasted needs but cannot exceed 80 percent of the Department’s average annual charter spending over the five fiscal years ending the year before the contracts are awarded; the Secretary can leave out an unusually high-demand year to make the average more accurate. The total is divided among carriers by their CRAF commitments, and the Secretary can adjust a carrier’s share if it is unavailable because it refused work, suspended operations, or was put in nonuse status under section 2640 for safety reasons. Any unused guaranteed amount for a fiscal year must be paid to the carrier before the next fiscal year starts. Each military department must transfer its share of expected payments into the transportation working capital fund by the last day of the fiscal year unless payments were already made, and each department is entitled to a share of services equal to its contribution and may transfer that entitlement to other DoD parts. “Charter air transportation” is defined in 49 U.S.C. 40102(14).
