§1107 Rights, Powers, and Duties of Debtor in Possession

Title 11 › Chapter 11— REORGANIZATION › Subchapter I— OFFICERS AND ADMINISTRATION › § 1107

Last updated Apr 3, 2026|Official source

Summary

A debtor in possession has the same rights and powers as a trustee, except they cannot get trustee pay under section 330 and they do not have to do the duties listed in section 1106(a)(2), (3), and (4). Those rights and powers can be limited by trustee rules or by the court. Despite section 327(a), a person is not automatically barred from being hired by the debtor in possession just because they worked for or represented the debtor before the case began.

This section places a debtor in possession in the shoes of a trustee in every way. The debtor is given the rights and powers of a chapter 11 trustee. He is required to perform the functions and duties of a chapter 11 trustee (except the investigative duties). He is also subject to any limitations on a chapter 11 trustee, and to such other limitations and conditions as the court prescribes cf. Wolf v. Weinstein, 372 U.S. 633, 649–650 (1963).
