A debtor in possession has the same rights and powers as a trustee, except they cannot get trustee pay under section 330 and they do not have to do the duties listed in section 1106(a)(2), (3), and (4). Those rights and powers can be limited by trustee rules or by the court. Despite section 327(a), a person is not automatically barred from being hired by the debtor in possession just because they worked for or represented the debtor before the case began.
