Title 11 › Chapter 7— LIQUIDATION › Subchapter III— STOCKBROKER LIQUIDATION › § 746
If, after the petition is filed but before a trustee qualifies under section 322, someone makes a good‑faith deal with the debtor that would have made them a customer if done earlier, they are treated as a customer and the transaction date counts as the petition date for figuring net equity. No customer claim covers cash or securities that are part of the debtor’s capital or are subordinated to other creditors.
