Title 12 › Chapter 8— ADJUSTMENT AND CANCELLATION OF FARM LOANS › § 1150
The Secretary of Agriculture can settle, change, or wipe out farm loan debts and payments under the programs listed in section 1150a. After an investigation the Secretary considers sufficient, the Secretary must find that the debt has been due at least five years, the borrower cannot pay and has no reasonable chance to do so, the borrower tried in good faith to pay, and the principal owed is $1,000 or less. The Secretary can also cancel debts under $10, or cancel when the borrower is dead with no estate to pay, has been missing for two years with no way to collect, or was discharged in bankruptcy. The Secretary sets the rules for these actions and may use Department agencies or staff to carry them out.
