Title 12 › CHAPTER 46 — GOVERNMENT SPONSORED ENTERPRISES › SUBCHAPTER I — SUPERVISION AND REGULATION OF ENTERPRISES › Part B — Additional Authorities of the Director › subpart 2 — housing goals › § 4562
Requires the Director to set yearly percentage goals for each government mortgage buyer to buy standard, conforming single-family mortgages for owner-occupied homes. The goals cover two types: mortgages used to buy a home for low-income families, families in low-income areas, and very low-income families; and refinance loans that pay off an old loan for low-income families. Each goal is a percent of that enterprise’s total number of those kinds of mortgage purchases. The Director must make yearly targets by rule, no more than three years ahead, using the most recent three years of HMDA data and factors like national housing needs, market and economic conditions, past enterprise effort, market size, and the need to keep the enterprises financially safe. The Director may adjust targets if new data or market changes appear, and will not count market segments judged unsafe, unauthorized, or contrary to good lending practices. Each enterprise must report each year how many affordable rental units are in mortgages it bought that finance 2- to 4-unit owner-occupied properties. The Director checks every year if each enterprise met each goal. The Director will notify an enterprise of its compliance decision within 30 days and give the enterprise 30 days to comment. Income is measured at the time the loan was made. Mortgages on 2- to 4-unit owner-occupied homes count toward the goals even if some units are rented. The Director gives full, partial, or no credit for actions toward the goals and will give no credit for unsafe or unauthorized purchases.
