Title 12 › CHAPTER 46 — GOVERNMENT SPONSORED ENTERPRISES › SUBCHAPTER I — SUPERVISION AND REGULATION OF ENTERPRISES › Part B — Additional Authorities of the Director › subpart 2 — housing goals › § 4565
Enterprises must lead the effort to make more mortgage money available for very low-, low-, and moderate-income families. They must create loan products and more flexible underwriting for three underserved markets: manufactured homes; preserving affordable housing (including projects subsidized by major federal programs, rural rental programs, low-income housing tax credits, and similar state or local programs); and housing in rural areas. To do this, enterprises must design programs that work with federal, state, and local aid and build partnerships with nonprofit and for-profit housing groups and housing agencies. They must help lenders make loans in low-income and minority neighborhoods and help banks meet their Community Reinvestment Act duties by using sensible underwriting, pricing, fees, repurchase rules, and procedures. They must also build capacity to finance low- and moderate-income housing, including for first-time buyers. The Director may suggest adding more underserved categories if they matter to the mission. Starting in 2010, the Director must set rules to evaluate and rate each enterprise every year. The review looks at each underserved market separately and checks product development, outreach, loan purchases relative to opportunity (without fixed numeric targets), and investments or grants. Loans on manufactured homes can be counted even if they are secured by personal property. Affordable housing fund grants used under the law cannot be counted toward meeting this duty.
