Title 12 › Chapter 50— CHECK TRUNCATION › § 5009
If someone breaks a warranty or fails to follow a rule about a substitute check, they must pay the person harmed. The payment is the smaller of the loss the harmed person suffered or the amount of the substitute check. The payer must also pay interest and expenses, including costs and reasonable attorney fees, tied to the substitute check. Any payment is reduced by any recredit the claimant gets and keeps under sections 5006 or 5007. If the harmed person was partly at fault or acted in bad faith, the payment is cut by that share. This does not reduce any rights under the Uniform Commercial Code or other federal or state law.
