Title 12 › CHAPTER 53 — WALL STREET REFORM AND CONSUMER PROTECTION › SUBCHAPTER V — BUREAU OF CONSUMER FINANCIAL PROTECTION › Part E — Enforcement Powers › § 5563
The Bureau can hold formal hearings under the federal administrative rules to make sure people follow this law and other federal laws it enforces, unless a law says the Bureau cannot. It can serve a notice of charges and set a hearing about possible violations. The hearing is normally scheduled not earlier than 30 days and not later than 60 days after the notice, unless a different date is agreed. If the person does not show up or send a representative, they are treated as agreeing to a cease-and-desist order. If the Bureau finds the violation proved or the person has consented, it can order the person to stop the violation and to fix the harm. A normal cease-and-desist order takes effect 30 days after it is served, unless the order says it takes effect sooner. After the hearing, the Bureau must issue a written decision and orders within 90 days after telling the parties the case is ready. A person can ask a court of appeals for review within 30 days after the order is served, and an appeal does not automatically pause the order unless the court says so. If the Bureau believes a continuing violation could make a person insolvent or seriously harm consumers before the full hearing is done, it may issue a temporary cease-and-desist order that takes effect on service. The person can ask a United States district court within 10 days to block or limit that temporary order while the administrative process continues. If a person’s books or records are so incomplete or wrong that the Bureau cannot tell their financial condition, the Bureau may order them to stop related activities or to fix the records until the case ends or the Bureau finds the records accurate. The Bureau can ask a district court where the person’s main office is to enforce any effective order, and it must write rules to carry out these procedures.
