The Secretary must, when possible, publish up-to-date population totals and population characteristics each year for every State, county, and local government that has 50,000 or more people. For smaller local governments, the Secretary must, when possible, publish current total-population numbers every two years. The counts must cover the same places listed in the most recent census and can use sampling or other methods that give reliable, current data. If the Secretary cannot produce total-population data in any fiscal year for any county or local government required above, the Secretary must send a report to the President of the Senate and the Speaker of the House at least 90 days before the next fiscal year starts, naming each government left out and explaining why.
