Boards under section 2106 must send a report to the Secretary. If the board violated law or regulation, the Secretary may return it for revision. After review, the Secretary sends it to the President, who may approve, change, disapprove, or remove any officer. If approved, promoted officers’ names must be shared service-wide. Board proceedings, including special boards under section 2120, are confidential except as required. If the Secretary seeks to remove a name based on information not shown to the board, that information must be given to the officer and the officer allowed to comment; if classified, the officer must get a summary to the maximum extent practicable.
