The Secretary can take an officer off active duty when a board of inquiry under section 2159 recommends removal. That decision is final and cannot be changed.

The Secretary may remove an officer from active duty if his removal is recommended by a board of inquiry under section 2159 of this title. The Secretary’s action in such as case is final and conclusive.
