Title 15 › Chapter 30— HAZARDOUS SUBSTANCES › § 1278a
Any children’s product that has more lead than the limits below must be treated as a banned hazardous substance. The Consumer Product Safety Commission (the Commission) sets the limits and the schedule. Starting 180 days after August 14, 2008, the limit is 600 parts per million (ppm) of total lead in any part. Starting 1 year after August 14, 2008, the limit is 300 ppm. Starting 3 years after August 14, 2008, the Commission must replace the 300 ppm limit with 100 ppm unless it finds 100 ppm is not technologically possible for a product or group of products. If 100 ppm is not possible, the Commission will set the lowest feasible limit below 300 ppm for that product or group. The Commission must use the best science and technology available and review and lower the limits at least every 5 years. Each limit applies only to products made after the limit’s effective date. The Commission can grant an exception for a product, material, or part after notice and a hearing if the maker proves that lead is needed, the part won’t be mouthed or eaten in normal or reasonably foreseeable use, and the exception won’t raise children’s blood lead levels (or an alternate scientific measure if the Commission approves it). Parts that are not accessible to a child are exempt, but paint, coatings, or electroplating do not count as barriers. For some electronics the Commission can require child-resistant covers or other steps and set a schedule for compliance. Off-highway vehicles are not covered. Metal bicycle parts followed earlier temporary limits and after December 31, 2011 cannot exceed 300 ppm. Used children’s products are generally exempt except for children’s metal jewelry, items known to violate the limits, or other categories the Commission decides. The Commission’s rules override the ASTM F963 standard where they conflict.
