Title 15 › Chapter 36— CIGARETTE LABELING AND ADVERTISING › § 1333
Cigarettes sold or advertised in the United States must show one of nine specific health warnings about addiction, harm to children, fatal lung disease, cancer, strokes and heart disease, pregnancy harm, death, harm to nonsmokers, or that quitting greatly cuts health risks. The warning must be on the top half of both the front and back of the pack, under any clear wrapping, and normally in 17‑point type. If a warning would take up more than 70% of that area, the type may be smaller so the warning still fills at least 60% of the top half. The words must contrast with the package (black on white or white on black). Manufacturers, importers, and distributors who do not make, pack, or import cigarettes for U.S. sale are not covered. Retailers are not liable if the pack has an approved warning, the pack was supplied by a licensed maker/importer/distributor, and the retailer does not materially change it. All cigarette ads in the U.S. must also include one of the nine warnings. For press and poster ads, the warning must take up at least 20% of the ad area and appear prominently at the top. The law sets specific type sizes for different ad formats (for example, 45, 39, 27, 31.5, 22.5, and 15 point for various newspaper and magazine sizes). Small matchbooks may carry the warning inside the cover. Warning statements must be rotated so each brand shows the statements equally over each 12‑month period and are rotated quarterly in ads, under a distribution and rotation plan that the Secretary must approve. Within 24 months after June 22, 2009, the Secretary must require color pictures showing the harms of smoking to go with the warnings. The Secretary may make rules to change formats, sizes, graphics, or require tar, nicotine, or other constituent disclosures in ads or on packages, and must coordinate any differences with the Federal Trade Commission. Retailers are only responsible for these rules if they control or direct the warnings.
