Knowingly and willfully breaking section 2068 can lead to criminal punishment. A person who does so may be jailed for up to 5 years, fined as set in section 3571 of title 18, or both. A corporate director, officer, or agent who knowingly orders, allows, or does the wrongful acts can be punished the same way even if the corporation is also penalized. A criminal conviction can also include losing assets tied to the violation. "Criminal violation" means a violation that leads to a sentence to pay a fine, be imprisoned, or both.
