Title 15 › CHAPTER 47 — CONSUMER PRODUCT SAFETY › § 2078
The Commission must set up a program to help federal, state, and local governments work together to carry out this law. It can take help from state or local agencies with things like collecting injury data, doing investigations, and running education programs, and it can pay reasonable costs if agreed. It can also appoint qualified state or local employees to act as Commission officers for inspections and investigations. The Commission should favor state or local plans that create separate agencies to handle product safety and consumer protection. The Commission can get statistics and reports from other federal agencies and should work closely with them. It must try to use the National Institute of Standards and Technology, on a reimbursable basis, for research, tests, studies, and technical advice about product risks. The Commission can share accident or investigation reports with other government agencies only if secret parts required by section 2055(a)(2) are removed and the receiving agency promises not to reveal injured people’s or treating persons’ identities to the public. It can also share information with federal, state, local, or foreign government agencies under written agreements that require confidentiality and limit use to law enforcement or consumer protection; foreign sharing needs legal authority and, for criminal matters, Attorney General approval and is barred for countries on the terrorism-support list. The Commission can end any agreement if confidentiality is broken, and it generally does not have to release certain foreign-origin materials under FOIA, but it still must provide information to Congress and obey U.S. court orders. The Commission must notify each State’s health department when a maker voluntarily corrects a product problem or when the Commission issues certain orders.
