The Director of the National Institute of Standards and Technology makes rules that allow small differences and set acceptable tolerances, and the Secretary of Commerce must approve those rules. Criminal cases under this rule or under sections 234 or 235 can be started when local weights-and-measures officials or other state or territorial officers file a complaint. These rules do not apply to barrels used to pack or ship goods sold only by weight or by count.
