Title 15 › Chapter 59— RETAIL POLICIES FOR NATURAL GAS UTILITIES › § 3207
Federal courts generally cannot hear cases that come up under this chapter, except in two situations. One is when the Secretary brings a federal lawsuit to enforce the Secretary’s right to intervene under section 3205, and the court can order appropriate relief. The other is when the Supreme Court reviews a case under 28 U.S.C. 1257 or 1258. Anyone else can sue in a State court to enforce the chapter, following State court rules. The Secretary may not appeal or ask a court to review decisions by a State regulatory authority or a nonregulated gas utility, and may not become a party to such appeals. The Secretary may, however, take part as an amicus curiae (a friend of the court) in any judicial review of actions under this chapter.
