Creates an Office of Credit Risk Management inside the Administration to watch over certain lenders. The Office is in charge of supervising 7(a) lenders, Lending Partners and Intermediary participants in Office of Capital Access programs, small business lending companies, and non‑federally regulated lenders. Office: the unit inside the agency that oversees lender risk. Director: a career Senior Executive Service official who leads the Office and runs lender reviews. The Director must do regular reviews and must have an Office employee present or supervising any contractor review of a 7(a) lender, whether on the lender’s site or elsewhere. After a review ends, the Administrator must give the 7(a) lender a written report within 60 business days or tell the lender why and when the report will be late; if the report asks for a reply, the lender must answer within 45 business days. The Director can take informal penalties for violations and, with the Lender Oversight Committee’s approval, formal penalties based on seriousness or repeats, including civil fines up to $250,000. A 7(a) lender can appeal enforcement to the Office of Hearings and Appeals or a U.S. district court. Rules to carry out enforcement had to be issued within one year after June 21, 2018. The Director must also do an annual risk study of the 7(a) loan portfolio and send Congress a December 1 report each year (starting December 1, 2018) with overall and industry risk, a consolidated look at lenders responsible for at least 1% of approvals (dollar amounts and loan counts), steps taken to reduce risk, loan and loss totals, recoveries, and enforcement actions and penalties. Each year the Director must give the Administrator a budget request and explanation for the Office, timed with the President’s budget, and keep that info indexed and public for at least 5 years.
