The Commission can make rules to carry out the Act, except for the changes made by sections 4 and 12. Those rules must be made under section 553 of title 5. The Commission may not require any specific words, characters, marks, or labels in a commercial email. It also cannot force the identification required by section 7704(a)(5)(A) to appear in any particular part of the message (for example, the subject line or the body).
