Title 15 › CHAPTER 2B–1 — SECURITIES INVESTOR PROTECTION › § 78fff–3
SIPC must give the trustee money to quickly pay customers who are owed more than their share of customer property, up to $500,000 for each customer. If the extra amount is cash (not stocks or options), the cash part is limited to the “standard maximum cash advance amount,” which is $250,000 unless later adjusted. A person who has separate accounts in different roles counts as a separate customer for each role. If the trustee buys securities to satisfy a claim, those securities are valued as of the case’s filing date when checking the dollar limits. SIPC will not advance money for claims by certain insiders (like general partners, officers, directors, large owners, big limited partners, or people who controlled the firm). SIPC also will not advance money for a broker, dealer, or bank unless the trustee is satisfied the claim really came from that broker’s or bank’s customers; then each underlying customer is treated separately. When SIPC pays customers, it steps into their legal claims, but it cannot claim customer property until the property is first allocated to customers. SIPC must also advance money needed for a few specific cleanup tasks and to pay estate and liquidation costs if the firm’s own estate can’t. SIPC may, at its choice, advance money to pay or guarantee certain debts, guarantees, or to buy securities under other parts of the law. The $250,000 cash limit can be checked and changed by SIPC’s Board, with the Commission’s approval, starting January 1, 2011 and every five years after. Any increase is tied to a government price index, rounded down to the nearest $10,000, published by April 5 of the year the decision is made, and takes effect on January 1 of the next year. The Board must consider the fund’s condition, members’ economic situations, possible problems for members, and other relevant factors.
