Federal district courts and U.S. territorial courts can hear criminal charges and civil lawsuits that involve this law or its rules. Civil cases to enforce duties or to stop violations can be filed in federal courts at the same time as in state courts. Criminal cases can be filed where the illegal act happened. Cases for violations of section 80a–33, or for failing to file required reports, can be filed where the defendant lives or has their main office. Civil suits can be filed in any district with authority or where the defendant lives or does business, and legal papers can be served where the defendant lives, does business, or is found. When the Commission brings a case in a federal district court, its subpoenas for witnesses or documents can be served anywhere in the United States, and Rule 45(c)(3)(A)(ii) of the Federal Rules of Civil Procedure does not apply to those subpoenas. Court decisions can be reviewed under 28 U.S.C. sections 1254, 1291, 1292, and 1294. The Commission cannot be charged court costs in cases brought by or against it under this law. The Commission may join in any suit about enforcing or stopping violations of section 80a–35(b) at any time before the final judgment.
