§80b–14 Jurisdiction of Offenses and Suits

Title 15 › CHAPTER 2D — INVESTMENT COMPANIES AND ADVISERS › SUBCHAPTER II — INVESTMENT ADVISERS › § 80b–14

Last updated Sep 22, 2026|Official source

Summary

Gives federal district courts and U.S. territorial courts the authority to hear violations of this subchapter and its rules, and to handle civil lawsuits to enforce or stop those violations. Criminal cases can be tried where the bad act happened. Civil cases can be filed where the defendant lives, does business, or where the act took place, and papers can be served where the defendant lives, does business, or is found. When the Commission brings a case, its subpoenas can be served anywhere in the United States, and Rule 45(c)(3)(A)(ii) of the Federal Rules of Civil Procedure does not apply to those subpoenas. Court decisions can be reviewed under sections 1254, 1291, 1292, and 1294 of title 28. No court costs may be charged to or against the Commission in cases under this subchapter. Federal and territorial courts also have power over alleged violations of section 80b–6 when either (1) conduct inside the United States makes important steps toward the violation, even if the adviser and investors are foreign, or (2) conduct outside the United States is likely to have a big effect inside the United States.
