Knowingly breaking the rules or any permit under this chapter can lead to criminal punishment: a fine up to $20,000, imprisonment for up to one year, or both. Breaking the rules can also bring civil penalties of up to $10,000 for each violation. A person must be given notice and a chance for a hearing under federal hearing procedures before any civil penalty is decided. The Secretary (the federal official in charge) can issue subpoenas, take oaths, and require witnesses or documents; witnesses get the same fees and travel pay as in U.S. courts. If someone ignores a subpoena, a U.S. district court can order compliance and punish contempt. The Secretary can reduce or cancel penalties for good cause, and may ask the Attorney General to sue in federal court to collect unpaid penalties.
