Title 16 › Chapter 25B— REEFS FOR MARINE LIFE CONSERVATION › § 1220a
The Secretary may give a State ownership of obsolete ships for free after reviewing comments under section 1220(c) if he finds the State’s planned use will not break any federal law, harm the marine environment, cause undue interference with commercial fishing or navigation, and is not frivolous. To get the ships, the State must promise to use and maintain them only as approved and to chart and mark any ship if it is sunk; obtain any federal licenses or permits needed; accept any other terms the Secretary requires to protect the environment and U.S. interests; and cover all costs so the transfer is at no cost to the Government (except any financial help under section 1220(c)(1)). The State must take the ships and titles in an as-is, where-is condition at the place and time the Secretary of Transportation sets.
