The Secretary must enforce these rules and can use people, services, or facilities from other federal agencies to help. The Secretary can also name state or territorial officers to act as federal enforcement agents; those officers can carry out federal enforcement but are not treated as U.S. employees for laws run by the Director of the Office of Personnel Management. Federal judges and magistrates can, on oath and a showing of probable cause, issue warrants or other process needed to enforce the rules, including in admiralty cases. Anyone the Secretary authorizes can execute warrants and, in addition, may arrest people who break the rules in their presence, search vessels or containers with a warrant or when there is reasonable cause, seize cargo used against the rules, and seize any marine mammals or marine mammal products found in violation and then dispose of them under the Secretary’s regulations. When seizures happen, the Secretary must speed up the related proceedings under sections 1375(a) or (b). Seized items are held by an authorized person and the owner or consignee must be notified quickly. The Secretary may accept bond instead of holding the items. After a civil penalty under section 1375(a), seized items may be forfeited to the Secretary; after a criminal conviction under section 1375(b), seized marine mammals and their products must be forfeited to the Secretary (other seized items may be forfeited or disposed of by the court). If a civil penalty is assessed and no court action to forfeit the items is started within thirty days after that assessment, the items must be returned immediately. If there is no conviction and the Secretary does not, within thirty days after the final outcome of the case, begin civil penalty proceedings under section 1375(a), the seized items must be returned immediately.
