Title 16 › Chapter 44A— ANTARCTIC MARINE LIVING RESOURCES CONVENTION › § 2436
The Secretary of Commerce must write the rules needed to carry out this chapter. Before doing so, the Secretary of Commerce must talk with the Secretary of State, the head of the department that runs the Coast Guard, and other relevant agency leaders. If the Secretary of State notifies the Commission under section 2434(a)(1) about a conservation measure that (1) has been in effect 12 months or less, (2) the Commission adopted, and (3) the Secretary of State did not notify the Commission in the required time under section 2434(a)(1) during the objection period in Article IX, then the Secretary of Commerce may publish a final regulation in the Federal Register even if the usual notice-and-comment steps in section 553(b), (c), and (d) of title 5 are skipped. Once published, that conservation measure takes effect for the United States.
