Title 16 › Chapter 47— SMALL HYDROELECTRIC POWER PROJECTS › § 2705
The Commission must set up a program to use simple, fast licensing under the Federal Power Act for small hydroelectric projects at existing dams. Before giving a license, the Commission must check the safety of any existing dam or structure, including what might happen if it failed, and must allow consultation with the Council on Environmental Quality and the Environmental Protection Agency about environmental effects. Applicants are encouraged to use public money or other help to build needed fish and wildlife facilities. The Commission may, by rule or order, exempt a small project with a proposed capacity of 10,000 kilowatts or less from some or all Part I requirements, either case-by-case or by classes of projects. Any exemption must follow the same fish, wildlife, and environmental limits that apply under section 30(c) and (d) of the Federal Power Act, and it cannot waive or limit the requirement to offer consultation with the Council on Environmental Quality and the EPA.
