The Secretary must pay for and help buy agricultural land easements on eligible farmland. The program pays for easement purchases by qualified groups, technical help (including help making a conservation plan), and buy-protect-sell deals. The Federal share can be up to 50% of the easement’s fair market value as set by a standard appraisal, an area market study, or another industry method. The local or nonprofit partner must match at least that share. For special grasslands, the Federal share may be up to 75%. The partner’s share can be cash, a landowner donation, costs for appraisal or title work, or other approved costs. The Secretary will make rules to rank projects, with priority on protecting farm uses and keeping land in farming. Agreements with partners set terms and conditions. Certified partners get at least 5-year agreements; other partners get 3 to 5 years. Partners can use their own easement terms if they meet the program’s goals. The Secretary keeps a backup enforcement right if the partner fails to enforce, and inspections are allowed only with notice or if reports are late or a violation is suspected. Conservation plans are required only for highly erodible cropland. Limited subsurface mineral work can be allowed if it doesn’t harm farming, follows a remediation plan, is approved beforehand, and is not surface mining. Violations can lead to ending the agreement and repaying funds with interest. The Secretary may certify experienced entities (for example, those with accreditation or at least 10 past easements) and reviews them every 3 years, giving at least 180 days to fix problems before revoking certification. Land is enrolled by permanent easements or for the longest term allowed by state law. Technical help for following easement rules is available on request.
