Title 16 › Chapter 60— FISH AND SEAFOOD PROMOTION › § 4004
Creates a National Fish and Seafood Promotional Council. The Council has the Secretary of Commerce as a nonvoting member and 15 voting members the Secretary appoints. Nominations must be sent in the way the Secretary requires. Members come from four regions: Northeast (Maine, New Hampshire, Massachusetts, Rhode Island, Connecticut, New York, New Jersey, Delaware, Pennsylvania, Maryland, Virginia), Southeast (North Carolina, South Carolina, Georgia, Florida, Alabama, Mississippi, Louisiana, Texas, Puerto Rico, Virgin Islands), Pacific (Idaho, Washington, Oregon, California, Hawaii, Guam, American Samoa, Northern Mariana Islands), and Alaska (Alaska). Each region has three voting members (one harvester, one processor or receiver, and one marketer). There are two at-large members with inland/freshwater fishery expertise (at least one must not live in the four regions listed) and one at-large member who is either a professional who shares information about fish nutrition/preparation or a union member with fisheries expertise. Members serve four-year terms. Vacancies do not stop the Council; the Secretary must fill a vacancy within 60 days and members may stay until their successor is named. The Council elects a chair each year by majority if a quorum is present. Ten members make a quorum, though fewer can hold hearings. The Council had to meet first within 180 days after November 14, 1986. Members are unpaid but are reimbursed for reasonable travel costs and expenses under section 5703 of title 5.
