§410cc–32 Park Preservation Plan and Index

Summary

The Commission must send the Secretary a draft park preservation plan within one year after its first meeting. The Secretary has 90 days to suggest changes. The Commission must then send a final plan within 18 months. The Secretary has 90 days to approve or reject it and cannot approve it unless the plan will properly carry out the subchapter’s goals. If rejected, the Secretary will explain why and suggest fixes, and the Commission must submit a revised plan in the time the Secretary sets. If approved, the Secretary will publish notice in the Federal Register and send copies to Congress. Any plan or draft must be made public on request. No major changes can be made to an approved plan without the Secretary’s OK. The Secretary cannot give funds for sections 410cc–33 or 410cc–34 until a plan is approved, except the Secretary may fund specific approved activities before approval. The Commission may ask for money to preserve listed park properties, to give emergency help to owners of nationally important properties, or to buy properties that are on the Lowell report, on the National Register of Historic Places, or found nationally significant by the Secretary. The plan must explain how the Commission will preserve, restore, manage, develop, or maintain 10 specific historic properties (including the Welles Block; Jordan Marsh Company Building; Yorick Club; Lowell Gas Light Company; St. Anne’s Church and Rectory; Lowell Institution for Savings; Ahepa Building; Boott Mill; Lowell Manufacturing Company on Market Street; and the Early Residence at 45, 47, and 49 Kirk Street). It must list the properties in the index, say which properties the Commission plans to acquire under section 410cc–34 and how they will be used, include the standards and criteria from subsection (e), describe grant and loan programs under section 410cc–33 (with estimated amounts and how awards will be made), provide a visitor transportation program (including barge equipment, docking, and local rail), offer education and cultural programs, and include a tentative budget for the next five fiscal years. The Commission must create the index within one year after its first meeting; the index must list nationally significant park properties (except those in 410cc–21(a)(2)) and nearby properties that should be preserved because of their proximity. The Commission must also adopt standards for work and use in the preservation district and for park properties within one year, with specified advice and approvals, and the Secretary will publish those standards and any revisions in the Federal Register.
