§410hhh–6 Acquisition of Property and Boundary Adjustments

Summary

The Secretary can obtain land inside the area shown on the map as the “Acquisition Area” or inside the national monument by buying it, accepting a gift, getting it from another federal agency, or swapping property. The owner must agree before any land is taken. Land owned by the State of Colorado or its local governments can only be obtained by gift or exchange. As soon as possible after getting land, the Secretary must change the unit’s boundary to include the new land. After acquiring land, the Secretary will give it to the right agency to manage. The National Park Service will get land added to and run as part of the Great Sand Dunes National Monument, or later the Great Sand Dunes National Park (after it is designated) or the Great Sand Dunes National Preserve. The U.S. Fish and Wildlife Service will get land added to the Baca National Wildlife Refuge. Any land shown on the map in Zone B goes to the Secretary of Agriculture and is added to the Rio Grande National Forest. For the rules in sections 100506(c) and 200306 of title 54, the forest boundaries after that transfer count as the national forest boundaries.
