Title 16 › CHAPTER 1 — NATIONAL PARKS, MILITARY PARKS, MONUMENTS, AND SEASHORES › SUBCHAPTER LIX–O — NATIONAL PARK OF AMERICAN SAMOA › § 410qq–2
The Secretary must run the park under this subchapter and the usual National Park Service laws. The Secretary can use legal powers needed to protect wildlife and cultural and natural resources, but may only get land or water for the park by lease. Farming, cultural activities, and gathering for subsistence are allowed if they were already happening in the same areas on October 31, 1988, and are done the traditional way; these uses cannot be for anything other than subsistence. Subsistence fishing and gathering in the park’s marine areas are allowed under the same rules, and no marine taking is allowed for non-subsistence purposes. Park explanations and visitor materials must be in English and Samoan. The Secretary may hire workers who are not covered by regular civil service rules and may sign contracts with individuals to carry out park duties. A training program must be set up for native American Samoans to work as park staff, help visitors, and run park facilities, and the Secretary should prefer hiring native American Samoans when practical. The Secretary and the Governor of American Samoa must make a general management plan that follows section 100502 of title 54 and includes plans to protect tropical forests, archaeological and cultural sites (including flying foxes) and to increase appropriate world-wide visitation. An Advisory Board of 5 members (3 nominated by the Governor) must be created; it will pick a chair, meet publicly and regularly, and members serve without pay though the Secretary may cover reasonable expenses on vouchers signed by the chair. Section 1013(b) of title 5 does not apply to this board. At least every 10 years, the Secretary and the Governor must review park operations, including how to meet park goals, needs for help, cooperative arrangements, and whether to extend the lease. The Secretary may use any legal authority, including help from other federal agencies, to provide technical assistance.
